1.4 Data Retention

Personal data is retained for the duration of the service relationship and for a maximum of 36 months following the last interaction, unless a longer retention period is required by law. Project deliverables and communications may be archived for quality assurance purposes.

ARTICLE 2

Terms of Service

2.1 Acceptance of Terms

By engaging the services of DigitalGrowthCraft, registered at 15 Rue Thiers, 56000 Vannes, France, you agree to be bound by these Terms of Service. These terms apply to all growth marketing, UI/UX development, and web architecture services provided.

2.2 Scope of Services

All services are delivered as described in individual service agreements and proposals. DigitalGrowthCraft provides growth marketing strategy, interface system development, product flow optimization, and scalable web architecture services. Specific deliverables, timelines, and pricing are defined in the applicable Statement of Work (SOW).

2.3 Payment Terms

Invoices are due within 14 calendar days of issuance unless otherwise agreed in writing. Late payments incur a statutory interest rate of three times the French legal interest rate. DigitalGrowthCraft reserves the right to suspend services if payment is overdue by more than 30 days.

2.4 Intellectual Property

Upon full payment, all intellectual property rights for final deliverables transfer to the client. DigitalGrowthCraft retains ownership of pre-existing tools, frameworks, and methodologies used in service delivery. Source code, design assets, and architectural specifications are transferred as defined in the SOW.

2.5 Limitation of Liability

DigitalGrowthCraft's total liability shall not exceed the total fees paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages. Performance guarantees are limited to the specifications defined in the applicable SOW.

2.6 Termination

Either party may terminate with 30 days written notice. Upon termination, client is liable for all work completed to date. DigitalGrowthCraft will deliver all completed work product within 14 business days of termination notice.

Cookie Policy

3.1 What Are Cookies

Cookies are small text files stored on your device by your web browser when you visit a website. DigitalGrowthCraft uses cookies to ensure our platform functions correctly and to improve your experience.

Refund & Reimbursement Policy

4.1 Refund Eligibility

DigitalGrowthCraft, located at 15 Rue Thiers, 56000 Vannes, France, offers refunds under the following conditions: (a) services have not yet commenced, (b) deliverables materially fail to meet the specifications defined in the Statement of Work, or (c) project cancellation occurs before the first milestone delivery.

4.2 Refund Calculation

Refunds are calculated based on the proportion of work completed at the time of cancellation. Deposits are non-refundable once work has commenced. For milestone-based billing, completed and approved milestones are non-refundable. Unapproved work may be eligible for partial refund pending review.

4.3 Requesting a Refund

Refund requests must be submitted in writing to [email protected] within 14 calendar days of the service delivery or invoice date. Include your project reference, invoice number, and detailed description of the issue. We will acknowledge receipt within 48 business hours.

4.4 Processing Timeline

Approved refunds are processed within 14 business days using the original payment method. If the original method is unavailable, an alternative arrangement will be proposed. Refund processing times may vary depending on your financial institution.

4.5 Dispute Resolution

In the event of a disagreement regarding refunds, both parties agree to attempt good-faith resolution through direct communication before pursuing formal dispute mechanisms. Unresolved disputes are subject to the jurisdiction of the courts of Vannes, France, in accordance with applicable French consumer protection law.
